A residence permit for the purpose of family reunification may be granted to a third-country national family member of a third-country national who is a holder of a residence permit or an immigration permit, an interim permanent residence permit, a national permanent residence permit or an EC permanent residence permit, a temporary residence card, a national residence card or an EU residence card, or of a Hungarian national, or of a person who is a holder of a residence card, a permanent residence card for EEA nationals or a permanent residence card for third-country national family members under Act I of 2007 on the Admission and Residence of Persons with the Right of Free Movement and Residence.

A residence permit for the purpose of seasonal employment may be granted to a third-country national guest worker whose purpose of residence is to undertake seasonal employment.

A residence permit for the purpose of intra-corporate transfer may be granted to a third-country national who is transferred (posted) from a parent company registered in a third country to a subsidiary company of a group of companies/corporate group which is registered in the territory of a Member State/Members States of the European Union and has a chief-executive or expert position in the parent company or is a trainee with tertiary educational attainment and has sufficient experience and legal relationship and his/her employment is supported.

A residence permit for the purpose of traineeship may be granted to a third-country national who is able to prove that:

  1. (s)he intends to reside within the territory of Hungary for the purpose of traineeship under a traineeship contract with an organisation hosting accepted trainees which undertook the obligation to cover the costs related to the expulsion of the applicant in case the trainee’s residence period of time exceeds the approved validity period of the trainee’s residence, if the required financial means to cover the related costs are not available to the trainee, in writing,
  2. has acquired the tertiary education attainment required for the undertaking of the traineeship within 2 years prior to the application submission or is pursuing studies in a degree programme in tertiary education which is in compliance with the traineeship activity,
  3. (s)he has the required language skills to undertake and finish the traineeship.

A residence permit for official purposes may be granted to a third-country national who intends to reside within the territory of Hungary:

  1. as a person enjoying any special privileges and immunities under diplomatic relations or international law, or as a family member of such a person,
  2. as a member of an official delegation of a foreign state or foreign government body or international organisation,
  3. as a press correspondent (i.e. journalist),
  4. as a person seeking admission within the framework of an international convention/treaty/agreement, international cooperation in the field of culture, education or science or an intergovernmental aid programme for the purpose of study, education, science, training or participating in a continuing further education/professional training programme,
  5. as a staff member of a scientific, educational or cultural institution operating in Hungary under an international convention/treaty/agreement or as a person seeking admission into Hungary in the course of the activities of such an institution.

An EU Blue Card may be granted to a third-country national who

  1. has the tertiary education (deeming a graduate thereof a highly qualified personnel) required for the undertaking of the position or has relevant professional experience of a specific time deeming the personnel as highly qualified,
  2. is a holder of an EU Blue Card issued by a Member State of the European Union and has legally resided within the territory of the Member State issued the Card at least for 12 months or has resided within the second Member State at least for 6 months.

An EU Blue Card entitles its holder to reside within the territory of a Member State of the European Union while undertaking employment in a position requiring to be filled by a highly qualified personnel as per the conditions defined under Section 39 of Act XC of 2023.

A residence permit for the purpose of seeking a job or starting a business may be granted to a third-country national:

  1. who is a holder of a valid residence permit for the purpose of research and is able to prove the completion of the research activity, or,
  2. who is a holder of a valid residence permit for the purpose of studies and is able to prove that (s)he managed to finish the studies and the job sought or the business to be started by the third-country national corresponds to the completed research or the level of the finished studies.

A residence permit for the purpose of research may be granted to a third-country national:

  1. who is seeking admission to the territory of Hungary for the purposes of carrying out a research project under a hosting agreement concluded with a research organization accredited under specific other legislation; and
  2. the research organization undertook the obligation to cover the costs related to the expulsion of the applicant in case the researcher’s residence period of time exceeds the approved validity period of the researcher’s residence, if the required financial means to cover the related costs are not available to the researcher.

A third-country national holding a residence permit issued by a Member State of the European Union shall be granted a long-term mobility residence permit for the purpose of research to stay in the territory of Hungary for a period exceeding 180 days, if (s)he intends to carry out part of his/her research in a Hungarian research organization under a hosting agreement concluded with a research organization accredited under specific other legislation. A family member of a third-country national who is a holder of a valid residence permit issued by the first Member State on the basis of family relationship shall be granted the same residence permit upon submission of an application as specified above.

A residence permit for the purpose of medical treatment shall be granted to a third-country national:

  1. who intends to stay in the territory of Hungary for the purpose of receiving medical treatment,
  2. who is accompanying his/her minor child or any other family member in need of support provision for receiving medical treatment in the territory of Hungary.

A residence permit for the purpose of study shall be granted: who has been admitted to or accepted by a public education institution registered in the public education information system for pursuing a full-time course of study in the regular school system or in daytime courses of study under a student relationship in Hungary or is pursuing full-time education and training in a State-recognized institution of tertiary education or a foreign tertiary education institution authorized to operate in the territory of Hungary in daytime courses of study, or seeking residence in Hungary in order to attend a course in a tertiary education institution, which may cover a preparatory course prior to such an education.

A student mobility residence permit shall be granted to a third-country national who is a holder of a residence permit for the purpose of studies granted by any Member State of the European Union and is not covered by a Union or multilateral program that comprises mobility measures or by an agreement between two or more tertiary education institutions and (s)he intends to carry out part of the studies in a tertiary education institution provided for in specific other legislation.

A residence permit for the purpose of voluntary service shall be granted to third-country nationals to third-country nationals seeking admission into the territory of Hungary, and to volunteers participating in the European Voluntary Service.

New purposes of residence under Act XC of 2023 on General Rules for Admission and Right of Residence of Third-Country Nationals

A residence permit for the purpose of guest self-employment shall be granted to a third-country national,

  1. whose purpose of residence is to perform actual work independently, for remuneration (e.g. under self-employment, or
  2. who, as an owner or managing director of a company, association or other – established for gainful activities – legal entity (hereinafter referred to as business organisations collectively), intends to perform actual work within the scope of this activity. Please note that a residence permit for the purpose of guest self-employment shall be granted only to those third-country nationals who are members of business organisations concerned as their executives.

A residence permit for guest investors shall be granted to a third-country national whose entry and stay in Hungary is in national economic interest due to his/her investments realised in Hungary.

A residence permit for employment for the purpose of investment shall be granted to a third-country national whose employment is realised as part of an investment-project.

A residence permit for the purpose of employment shall be granted to a third-country national:

  1. whose purpose of residence is to perform actual work for or under the direction of others, for remuneration, under contract for employment relationship,
  2. whose employment is based on an existing employment relationship with an employer established in a third country, in order to fulfil an agreement concluded with a Hungarian employer (in this case the Hungarian employer is considered to be the employer)

A residence permit for guest workers shall be granted to a third-country national

  1. whose employer is registered as a preferential employer or a qualified temporary work agency (i.e. lender of labour force),
  2. who are third-country nationals as defined in the Decree by the minister responsible for employment of third-country nationals in Hungary, issued with the approval of the Protection Committee, and
  3. who undertake work under employment not precluded by the Communication by the minister responsible for employment policy.

A Hungarian Card shall be granted to a third-country national

  • whose purpose of residence is to perform actual work for or under the direction of others, for remuneration, under contract for employment relationship,
  • who, as an owner or managing director of a company, association or other – established for gainful activities – legal entity, performs actual work in addition to the activities within the scope of this activity,
  • with higher professional qualifications who is employed in Hungary on the basis of an agreement concluded between an employer established in a third country and a Hungarian employer in order to fulfil an agreement.

Even if the above requirements are fulfilled, a third-country national shall only be granted a Hungarian Card, if the applicant

  • has a professional qualification specified in the Decree by the minister responsible for higher education,
  • is a professional athlete/sports(wo)man or trainer/coach,
  • is a performer, or
  • is to perform actual work at a film production business registered under the Motion Picture Act by the official authority of motion pictures.

A National Card shall be granted to a Serbian or Ukrainian national whose purpose of residence is to perform work for or under the direction and/or supervision of others, for remuneration, under employment relationship; including employment through temporary work agency.

A residence permit for the purpose of training shall be granted to a third-country national who is participating in a scholarship-based training course in Hungary provided by the Government or the Ministry and meets the conditions set int he legislation.

A person who fulfils the conditions for the issuance or extension of a residence permit for the purpose of studies shall not be granted a residence permit the purpose of training.

A residence permit for the purpose of posted work shall be granted to a third-country national

  • who is a holder of a valid residence permit for the purpose of employment issued by a Member State of the European Union, and
  • is to undertake his/her employment in Hungary under employment relationship with the posting business for a limited period of time:
    • in the name and under the direction of the posting business, under contract between the posting business and the recipient of the service in the given Member State,
    • at the work premise of the posting business group or at the business, or
    • posted by the posting temporary work agency business or labour force providing business to a business established or functioning in Hungary.

The posting business and the employer are under employment relationship during the time period of the posting, service provision is carried out in the own name of the posting business and under its own direction, under the contract concluded between the posting business and the recipient of the service in the given Member State.

In national interest the Minister responsible for aliens policing and asylum shall grant a residence permit for reasons of national interest. During the procedure, Hungary’s economic, national policy, culture and sports interest are considered.

The Minister responsible for aliens policing and asylum shall grant a residence permit for reasons of national interest also to a third-country national whose purpose of residence is to perform actual work in Hungary for or under the direction of others, for remuneration, under contract for employment relationship.

A White Card shall be granted to a third-country national who has a verified employment relationship in a country other than Hungary and performs his/her work from Hungary using an advanced digital technology solution, or owns a share in a company with a verified profit in a country other than Hungary and performs his/her work or manages his/her company from Hungary using an advanced digital technology solution but does not undertake work in Hungary and does not own a share in a company.
