Family member of the third country national or Hungarian citizen shall mean:

1. the spouse of a third-country national or a Hungarian citizen (according to the Act XXIX. of 2009, same-sex cohabitants having a registrar certificate in proof of registered partnership status shall be considered as spouses)
2. the minor child, including adopted and foster children, of a third-country national and his/her spouse
3. the minor child, including adopted and foster children, of a third-country national where this third-country national has parental custody and the children are dependent on him/her
4. the minor child, including adopted and foster children, of the spouse of a third-country national or a Hungarian citizen where the spouse has parental custody and the children are dependent on him/her
5. the person who has parental custody of a minor child who is a Hungarian citizen, exercising parental authority and living in the same household with the Hungarian citizen
