An EC residence card may not be granted for a third-country national:
- who is residing in the territory of Hungary for the purpose of pursuing studies in an institution of higher education or vocational training
- who is residing in the territory of Hungary for the purpose of seasonal employment or voluntary service activities
- who is residing in the territory of Hungary under diplomatic or other personal immunity
- who submitted an application for refugee status or temporary protection or subsidiary protecion to the asylum authority, pending a final decision on his/her application
- who has been given temporary protection on the principle of non-refoulement
- who has been recognized as a refugee or granted subsidiary protection by the Hungarian asylum authority or court or any Member State of the European Union, on the basis of such status, and who no longer has refugee status or subsidiary protection; and
- who has been granted temporary protection
